Criminal Defense Case Results

The following are some of the criminal defense case results from this office:

  • Operation Under the Influence / Driving Under the Influence:  After a long day at the construction site, the client was returning to his shop when he was stopped for speeding.  Despite the presence of empty bottles in the truck, the client was found not guilty of OUI after trial.
  • Operation Under the Influence / Driving Under the Influence:  Client was stopped driving back home after a house party.  He was tired and had an argument with the officers during booking, but was found not guilty of OUI after trial.
  • Domestic Assault & Battery:  The client and girlfriend began arguing in their car.  When the argument ended, the girlfriend was out of the car and claimed to have been pushed.  At trial the client was found not guilty of domestic assault.
  • Operation Under the Influence / Driving Under the Influence:  After a night out with friends, a gentleman was stopped for speeding while on his way home.  After taking a breath test with a reading of .07 the client was charged with OUI Liquor, but was found not guilty of OUI at trial.
  • Drug Trafficking: A man charged with trafficking in oxycodone and represented by Attorney Angiulo was found not guilty of trafficking at trial.
  • Operation Under the Influence / Driving Under the Influence: A woman leaving a wedding was charged with operation under the influence and resisting arrest. Attorney Angiulo represented her at trial where a not guilty verdict was reached.
  • Operation Under the Influence of Drugs:  A member of the Massachusetts State Police issued charges for OUI Drugs, OUI Liquor and Negligent Operation against a man who told the truth about having taken his methadone prescription. The client was found not guilty of OUI at trial.
  • Assault and Battery: A man assaulted by the mother of his children at a parenting exchange was charged with domestic assault and battery as well as resisting arrest and was represented by Attorney Angiulo at trial where a not guilty verdict was reached.
  • Operation Under the Influence / Driving Under the Influence: A man who was seen racing his truck on a hillside was charged with OUI, malicious destruction of property and trespassing.  He was found not guilty of OUI at trial.
  • Operation Under the Influence / Driving Under the Influence:  A woman facing a second offense OUI charge was outside of her car when the officers arrived.  She was found not guilty of OUI at trial.
  • Negligent Operation and Leaving the Scene of Property Damage:  Officers had eyewitnesses to a car crash claiming a woman matching the defendant’s description was driving the car at the time of the collision.  Despite that information, the investigating police department failed to have a citation delivered or mailed as required by MGL c. 90C, section 2.  After a motion hearing, the case against the client was dismissed.
  • Operation Under the Influence / Driving Under the Influence:  Whenever a breath test may be admitted against a defendant, there is a question whether the test was administered in accordance with the law.  Whenever a booking video exists, the government is required by Massachusetts Rules of Criminal Procedure to turn it over.  This video is material evidence regarding a defendant’s sobriety as well as evidence about whether the breath test was done correctly.  When the government failed to turn over the video, Attorney Angiulo successfully had the case dismissed.
